Terms & Conditions – Brown Girl Tours Effective

These Terms & Conditions (“Terms”) govern all bookings made with Brown Girl Tours (“we,” “us,” “our”). By booking a tour or service, you agree to these Terms.
1. Booking & Payment
1.1 Booking Confirmation – A booking is only confirmed once we have received the required deposit or full payment and issued a confirmation email.
1.2 Deposit – A non-refundable deposit of 10% of the cost of the tour is required to secure your booking.
1.3 Full Payment – The remaining balance must be paid no later than 2 days before the tour date.
1.4 Methods of Payment – We accept payments via cash.[credit/debit card, bank transfer, online payment platforms.
2. Cancellations & Refunds
2.1 Cancellations by the Client:
●Clients can cancel 24 hours before the tour with a full refund of any amount paid minus the non-refundable deposit.
● 2.2 Cancellations by the Company – We reserve the right to cancel a tour due to unsafe conditions, insufficient bookings, extreme weather, or unforeseen circumstances. In such cases, you may choose a full refund or reschedule at no extra cost.
2.3 Force Majeure – We are not liable for cancellations or changes caused by events beyond our control, including but not limited to natural disasters, government actions, strikes, or pandemics.
3. Client Responsibilities
3.1 Accuracy of Information – You must provide accurate personal details, including any medical conditions or special requirements, at the time of booking.
3.2 Travel Documents – You are responsible for ensuring you have valid identification, visas, permits, or any other documentation required for the tour.
3.3 Behaviour – We reserve the right to refuse participation or remove any person whose behaviour is disruptive, dangerous, or offensive, without refund.
3.4 Fitness & Health – You are responsible for assessing whether you are fit to participate in the selected activities. Some tours may require moderate to high physical activity.
4. Company Responsibilities
4.1 Service Delivery – We will provide the services as described in your booking confirmation, subject to reasonable changes to ensure safety and quality.
4.2 Qualified Guides – Our tours are led by knowledgeable and experienced guides.
4.3 Insurance – We recommend that you obtain personal travel insurance. We are insured for public liability but not for your personal belongings, medical expenses, or trip cancellations due to personal reasons.
5. Liability
5.1 Risk Acknowledgement – Many of our tours involve outdoor and adventure activities that carry inherent risks. By booking, you accept these risks and agree to participate at your own risk.
5.2 Limitation of Liability – To the extent permitted by law, we are not liable for any loss, damage, injury, or expense resulting from your participation, except where caused by our negligence.
5.3 Personal Belongings – We are not responsible for lost, stolen, or damaged personal items during the tour.
6. Changes to Itinerary
We may make reasonable changes to the itinerary, route, or activities due to weather, safety considerations, or other circumstances beyond our control.
7. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Trinidad and Tobago. Any disputes will be subject to the exclusive jurisdiction of the courts of Trinidad and Tobago.
